Jurisdiction
PressTigers marketplace is a trading brand of Nextwerk Inc. (registered in Connecticut, United States of America & Company No. 0820274).
The agreement between You (the purchaser) and Us (Nextwerk Inc.) will be concluded in the English language and our relationship with you will be governed by US laws and will be subject to the exclusive jurisdiction of the Connecticut, USA courts.
Interpretation
Any reference to a particular law or statute is a reference to it as it is in force for the time being and includes all changes to that law in the future. Words in the singular include the plural and in the plural include the singular. A reference to one gender includes a reference to the other gender. Condition headings do not affect the interpretation of these conditions. Clause headings shall not affect the interpretation of this agreement.
A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality) and that person’s personal representatives, successors or permitted assigns.
A reference to a company shall include any company, corporation or other body corporate, wherever and however incorporated or established. A reference to any party shall include that party’s personal representatives, successors or permitted assigns. A reference to writing or written includes letters, e-mail or any other electronic means.
No Warranties
Although we attempt to provide accurate information, names, images, pictures, logos, icons, documents, and materials (collectively, the “Contents”) on the Website, we make no representation, endorsement, or warranty that such Contents are accurate or suitable for any particular purpose.
Except when otherwise stated in writing the copyright holders and/or other parties provide the program “as is” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.
In no event unless required by applicable law or agreed to in writing will any copyright holder, or any other party who may modify and/or redistribute the program as permitted above, be liable to you for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the program to operate with any other programs), even if such holder or other party has been advised of the possibility of such damages.
Refund Policy – Products
Since we offer downloadable goods we do not issue refunds once the order is completed and the product is delivered. Compatibility requirements, and pre-requisites are clearly listed on our product pages, and you bear all responsibility for ensuring that you meet these requirements. We will not refund purchases for incompatibility issues, further, money will not be refunded due to misunderstandings about software compatibility.
Refund Policy – Services
Unlike downloadable goods hours purchased for service are refundable with only condition of incompetency of skill causing incomplete work by PressTigers. We issue refund within 7 working days.
Support
If you believe there is a fault with the product, then you should request support and we will provide assistance to identify any defect with the product, and rectify where reasonable. We cannot, and will not provide assistance with resolving faults outside the scope of the purchased product, or outside of the agreed support period.
You take responsibility for ensuring that you are running the latest stable versions of the product, or related software.
Upgrades
When purchasing a product we grant you the right (limited by the license option purchased) to receive upgrades on the sites nominated by you. Ordinarily you can expect to receive such updates for as long as the product remains on sale, however we reserve the right to exclude future updates from this agreement where the scope of developing such updates is significant.
We make no guarantees about compatibility of the current version with future releases of related software, nor do we guarantee that compatible versions will be released in the future.
Mis-priced Items
Despite our best efforts, products may occasionally be mis-priced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before sending or cancel your order and notify you of such cancellation.
Your Privacy
We use your personal information for the following reasons:
To provide you with the products you have requested and to notify you about important changes to the products you have bought;
To respond to support enquiries or general enquiries that you raise with us;
To provide you with information about other products of ours that you may be interested in;
We may contact you by e-mail for the purposes set out in this section. By submitting such information to us, you are deemed to have agreed to us contacting you using these methods of communication. We will continue to contact you using the methods you choose until you advise us in writing that you no longer wish to be contacted using such methods.
Sharing your personal information
We will not transfer, disclose, sell, distribute or lease your personal information to 3rd Parties other than on the following basis:
Where we have your consent to do so for the purpose of providing a service to you;
Where it is necessary to do so to provide products or services you have requested from us;
Where the disclosure is in compliance with legal and/or contractual requirements that we are subject to, including, but not limited to, intergovernmental agreements.
We will not pass your personal information to 3rd Parties (other than on the basis set out in these terms and in accordance with appropriate disclosure requirements we may be subject to) without your consent.

We will contact you after your purchase for feedback purposes. You will have the opportunity at this point to opt-out of further communications from us, which may include updates, and marketing information.
